Jirátková, M. Possibilities of Flexible Forms of Work in HR Management. Diploma thesis. Brno: Mendel University, 2024. This master's thesis explores the possibilities of flexible forms of work in the field of healthcare. It includes a literature review focused on flexible forms of work, human resource management, the labour market, digitization, and the impact of the COVID-19 pandemic on human resource management. The study conducted quantitative research in the form of a questionnaire and qualitative research through semistructured interviews with representatives of selected organizations responsible for human resource management. The findings of both inquiries were appropriately analysed, leading to the formulation of relevant recommendations.

Atypical Forms of Employment from the Perspective of Flexicurity Abstract The aim of this thesis is the assessment of the legal regulations of selected types of atypical employment from the perspective of the concept of flexicurity. It aims is to analyze the legal regulations of selected types of employment, to identify key elements of flexibility, security and employee protection, and critically evaluate whether the current legal framework meets the requirements of the Czech labor market or not. In case of the requirements not being met, possible solutions shall be proposed within the considerations de lege ferenda. This thesis consists of an introduction, four main parts, which are further divided into chapters and subchapters, and a conclusion. The first part offers a brief introduction to labor law. The second part focuses on the concept of flexicurity, its origin, various interpretations of different professionals, and its utilization in employment policies. It describes several different types of flexibility, security, and employee protection, and their reflection in labor law institutions. The third part is concerned with employment, dependent work, and the distinction between typical and atypical employment. 1 Flexible forms of work performance Abstract This diploma thesis concerns the topic of flexible forms of work performance, which is very relevant in today's era of rapid technological progress and changing labour market. Its aim was to describe those institutes of flexible work performance that are regulated by the Labour Code, as well as to consider each institute's advantages and disadvantages and to offer a view on the possible development of labour law. The considerations de lege ferenda are based on the identified practical shortcomings of the current legislation and the direction of the European Union, which to some extent determines the image of the domestic legal order. Part of the thesis is devoted to a brief introduction of several basic concepts essential for understanding further interpretation of flexible forms of employment. Furthermore the text focuses on the activities of the European Union and especially those of the Court of Justice. In particular it describes its fundamental doctrines concerning the direct effect of directives. Promoting the concept of Flexicurity by the Open Method of Coordination from the perspective of the Multi-Level Governance Theory and the Sociological Institutionalism - case study of the Czech Republic

This diploma thesis is a single-case study analyzing promotion of the concept of Flexicurity principle in the CR through the Open Method of Coordination (OMC). The concept of flexicurity began raising European integration actors' awareness since early 2000s. That was due to considerations how to strenghten competitiveness of the EU Member States' economies during growing expansion of more liberal markets such as China, and in the same time to maintain the European social model based on the concept of welfare state. In 2007, there was adopted EU's definition of Flexicurity. Flexicurity began to be promoted by the OMC. This thesis responds to the lack of studies analyzing the influence of the OMC in specific policy areas. Tha author analyzes literature, relevant laws as well as thier explanatory reports, National Reform Programmes, Czech government's policy statements, and interviews with representatives of tripartite actors who take part in social dialogue. The study explores how does the OMC work in the case of Flexicurity promotion. The aim is to find out which of the selected theories is more suitable for describing the process of Flexicurity promotion through the OMC. The concept merges two apparently opposite components of labour market, i.e. flexibility and security. Furthermore, this approach has been spontaneously developed in Denmark and the Netherlands and became an inherent part of socio-legal labour market policies promoted by European Union at the beginning of the twentieth century. First part of this paper reviews a situation of both components of flexicurity in the Czech Republic at the time when this thesis is formed. It describes the evolution of unemployment as well as the degree of flexibility and security on the Czech labour market and compares them with current situation in the rest of European states. Second part analyses flexible forms of employment in the Czech Republic, such as part-time jobs and its microeconomic implications. Contractual freedom and its limitation in the formation, changes and termination of the employment relationship

This thesis is focused on a contractual freedom in employment relations, especially upon formation, changes and termination of the employment relationship. The contractual freedom is the key principle of private law, therefore also of labor law, and the expression of the contractual freedom is the freedom of an individual in his choice whether to enter into an employment relationship, who to enter with, what content would the employment relationship have and when and how to terminate this relationship. The contractual freedom upon formation, changes and termination of an employment relationship is necessary to be limited due to protection, safety and certainty of employees and also in the public interest. One of the objectives of this thesis is to think about how should be this restriction of the contractual freedom limited. In this work there is also a description of a historical development of a regulatory autonomy of the will of the parties and a description of a statutory regulation of the formation, changes and termination of an employment relationship. Flexible forms of employment This diploma thesis deals with the flexible forms of employment as an alternatives to regular form of employment. The focus of the first two chapters is to determine the basic terms regarding the topic of this thesis; the following chapter concentrates on the flexible forms of employment regulated by Czech law in particular, i.e. Fixed-term contract, part-time job, homeworking, agreements on work carried out beyond employment and agency employment. In the scope of introduction of the particular flexible forms of employment this thesis in detail deals with the Czech law regulation of these forms of employment and follows up their benefits and drawbacks to the parties of the before mentioned agreements. The thesis briefly mentions some legal issues besides the labor law, especially the issues from fields of the social security law and the tax law.
Contractual freedom versus employee protection

The central theme of this diploma thesis is the mutual relationship between the employee protection and the contractual freedom as legal principles standing against each other. This relationship must be balanced as much as possible within the framework of legislation on labour law relationships, which is the task of labour law. This diploma thesis deals with the assessment of the level of flexibility against the legal instruments used to protect the employee. In other words, this diploma thesis attempts to outline the operation of the modern principle of flexicurity in the Czech law, while also explaining what the flexicurity itself means. The first part of this diploma thesis describes labour law in general terms as a legal branch, its aims and its object. At the same time, it outlines the historical development of labour law relationships with a focus on the operation of the contractual freedom and the employee protection in order to better understand the whole matters. Women between family and work. Conditions for harmonization of work and family in Prague

Diploma thesis "Women between family and work: Conditions for harmonization of work and family in Prague" is focused on current problem which is being dealt with on national as well as supranational level. The aim of this thesis is to describe the factors influencing harmonization of family and professional life of the mothers with children from two to six years old in region of Prague and find out whether the policy of state and regional governments reflect these factors. Chosen factors are described from the macro perspective but individual influences are also dealt with. On one hand the attention is allocated to state policy, especially from the point of view of Ministry of Labour and Social Affairs, but also from the point of selected municipality - municipal authority of Prague and municipality Prague 17.
Options of harmonization of work and family in terms of setting the pillars of flexicurity in the Czech Republic

Bachelor thesis "Možnosti harmonizace práce a rodiny z hlediska nastavení pilířů flexicurity v ČR" deals with situation regarding the setting of two of three pillars of flexicurity (numerical flexibility and jobs protection, employment protection supporting functional flexibility) and possibilities of harmonization of work and family in the Czech Republic. The goal is to evaluate which actions of flexicurity there are in our country and what effect they have on the situation regarding the reconciliation of work and family roles and what could be improved in this issue. Within the evaluation of the current situation was described and evaluated the system setting of childcare, which contributes by a large degree to opportunities for females on labour market and thus also to harmonize work and family. The issue has been consulted from a gender perspective. Also the system of active employment policy and lifelong learning, which contributes to functional flexibility, was described and evaluated. The second part is created by the results of interviews analysis, which were performed by the author with experts from organizations such as MPSV, Hospodářská komora, ČMKOS or Gender Studies.
